Affiliate Program Terms & Conditions

Before signing up for our affiliate program, you must read over our terms, conditions, and rules ("TOS") for the PLRNicheContent.com Affiliate Program, herein referred to as "Affiliate Program". If you do not agree with these terms, conditions and rules, you may not join this Affiliate Program.

An affiliate is defined as any person, business, or entity that inputs, or otherwise enters their information into the affiliate signup form.

Other terms used in this document: Affiliate Program Owner, herein "APO"; Company, which refers to Inoweb Marketing, LLC of Lansing, Michigan; Affiliated Parties, which refers to owners, subsidiaries, contractors, service providers, employees, agents and directors of the Company.

Affiliate Program Rules

1. Affiliates must be 18 years of age or older.
2. Affiliate accounts are limited to one (1) per household, not per person.
3. Affiliate contact information must be kept current at all times.
4. ¹ Affiliates may purchase products through their own affiliate link.
5. Affiliates agree that the APO is the sole arbiter in cases of a dispute regarding a breech of the TOS.
6. Affiliates may offer cash back / incentive based rebates to their referrals.
7. ²Affiliates may not mention company-issued codes to their referrals
8. USA-based affiliates must fill out and send in a W-9 tax form to receive more than $500 in earnings.

¹ Important Note: Due to the IP-address tracking feature, it would be nearly impossible for the average internet user (who becomes an affiliate) to purchase a PLR product through this website without referring themselves, as most affiliates click on their own links to test things out. For this reason, we are allowing affiliates to purchase through their own links. However, if the APO determines that the affiliate is merely using their account to receive discounted PLR products, and not actively referring new visitors to the website -- the APO, at his or her sole discretion, will terminate that affiliate's account. All unpaid, yet accrued earnings will be forfeited at that time.

² If an affiliate refers an individual to this website, the buyer cannot use a coupon code in conjunction with the referral, so affiliates must not mention company-issued coupon codes to their referrals.

Affiliate Privacy

With exception of an affiliates breech of the rules, terms and condition set forth on this page; the APO will not, in any way, share an affiliate's information with third parties except when required by legal authority. This information includes, but is not limited to, name, email address, physical mailing address, telephone number and IP address. If an affiliate is found in any way to be in breech of the rules, terms and conditions set forth on this page, this privacy policy is void.

All affiliate activities within the pages of this website and affiliate area are tracked for security, fraud prevention and statistics gathering purposes. The information being tracked and stored includes, but is not limited to: the pages accessed by an affiliate, the IP address of the affiliate used to access the pages, and the time and date that the pages are accessed. Any records for affiliate activity activity will be stored for no longer than 12 months. This activity tracking will in no way be shared with a third party with the exception of cases of fraud, potential fraud, abuse, or breech of the rules, terms and conditions set forth on this page.

Affiliate Tracking

The Affiliate Program tracking script uses a combination of cookies and IP Address matching to keep record of referrals. The cookies are set for 90 days to ensure that any sales that are sent to this website through an affiliate are credited to the proper affiliate, even if they decide to purchase a week or even a month later. The IP Address of the referral is stored in our system for 14 days after the latest clickthrough from an affiliate link and is a backup affiliate ID tracking system to credit the proper affiliate for a sale even if a referred user clears the cookies from their web browser.

Payment Policies

Pay periods run weekly from Saturday at 12:00:00am until the Friday at 11:59:59 pm. Payments are issued for the previous pay period's earnings and will be sent out within 3 business days of the end of the pay period.

At present, payments are issued to Affiliates via PayPal. There is no minimum payout amount using PayPal.

Affiliates may be charged a transaction fee by PayPal to accept earnings. View PayPal's payment acceptance fees on their website.

Affiliates are able to set a minimum-payment threshold. If set, affiliates' earnings will be held until the minimum-payment threshold is met, and they will be paid the following week. In the event of a refund or chargeback, earnings paid to affiliates will be deducted from unpaid earnings until the earnings amount is satisfied for the refunded or charged back product.

All pay period times are determined by the Website server's time, which is US Central Time.

These payment policies are subject to change at any time.

Affiliate Commission Percentages

The commission rate that an affiliate receives per sale is set at a fixed rate of 50%.

Affiliate Link Promotion Policies

Affiliates are, for the most part, free to advertise their Affiliate Program links in any way they see fit, so long as it's ethical. However, there are certain restrictions that apply, and those are outlined here.

Affiliates are currently free to offer incentives to referrals for purchasing the product or service offered on this website through their affiliate link. Incentives can be in the form of cash rebates, additional product offerings, membership access to a program that the affiliate operates, or a combination of any of these forms. However, affiliates cannot use bonuses that are currently listed as bonuses on the PLRNicheContent.com website, nor bonuses that were listed in the past on this website. If an affiliate uses an incentive based referral method, the affiliate must include disclaimer directly above or directly below the affiliate link stating that the bonuses offered are provided by the affiliate alone, and not in any way an offering by the PLRNicheContent.com website nor the management nor the owner of the website. A sample disclaimer, which affiliates are free to use (with slight modifications), is listed below.

Affiliates are free to change the disclaimer so long as the idea that PLRNicheContent.com is not responsible for the delivery of the incentives being offered. PLRNicheContent.com expressly disclaims any responsibility for delivering bonuses that affiliates use as incentives for referred purchases.

Affiliates are free to use PPC advertising to promote their affiliate links.

Affiliates may not use Auto or Manual Surf services to promote their affiliate link.

Affiliates are free to place their affiliate link on their websites provided the websites do not advertise sexually explicit content, promote hate or racism nor deal with topics or subjects that are illegal in the United States of America. This is a "family friendly" website, and websites that promote this service should be relatively family friendly.

Affiliates are free to place their affiliate links in forums provided that the links are contained in the "signature" section only, and only if the forum rules permit affiliate links in the signature area. Affiliates may instruct readers through their posts to visit their affiliate link in their signature, provided the post is on topic with the topic of the forum thread. Forum spamming is expressly forbidden.

Affiliates are free to use their affiliate link for the URL section in blog posting comments, provided an actual response to the posting is given. Affiliate links may not be used in blog comments if comments are not directly and obviously related to the blog posting that is being commented on. The use of automated blog comment posting software with an affiliate link from this website are expressly forbidden. Blog spamming of any types is expressly forbidden with affiliate links from this website.

The use of affiliate links with eMail advertising has strict guidelines, and they have their own section below.

eMail Related Promotion Policies

Because of the problems associated with spam complaints, I have very strict guidelines regarding the use of affiliate links in email messages.

In many circumstances, a single spam complaint will result in termination of an affiliate account and forfeiture of any unpaid commissions. I am very aware of what constitutes spam and what a misguided spam complaint is. However, my web hosting company may have the final say in whether a certain affiliate needs to be removed, regardless of the validity of the spam complaint or complaints.

Affiliate links may not be placed in emails sent to co-registration nor purchased leads. It doesn't matter what kind of "proof" an affiliate may have that the recipients are true "double-optin", unless the affiliate has built a list of email leads themselves, they cannot use affiliate links for this Affiliate Program in them.

Affiliate links may be placed in emails sent to a subscriber base provided the email subscriber is double-optin and the list has been created by the affiliate themself. Affiliates must maintain the following information for all email subscribers when using an affiliate link within the message body:

• First and/or Last Name
• Subscribed email address
• Date/Time stamp
• Subscribers IP Address
• URL of page where subscriber signed up for the eMail list

The URL of the page where the subscriber opted to receive eMails is imperative.

These are absolutely forbidden.

If a safelist is a true double-optin safelist, affiliates are allowed to use their affiliate link when using safelist services.

Affiliates may use their affiliate links in purchased eZine advertising provided they are 100% double-optin.

The sheer nature of "Get paid to" type services almost mandates that all email recipients are double-option, and they are allowed for use by affiliates provided they are double-optin.

Affiliate links may be used in an affiliates main email address signature provided that the affiliate does not send unsolicited single or bulk emails.

As an example, a prohibited method of using an affiliate link in an email signature is when an affiliate is responding to a classified ad (such as on craigslist.org) in order to promote a service or product instead of asking a legitimate question. This is a highly unethical, but unfortunately popular, marketing method; any use of an affiliate link in unethical email marketing is expressly forbidden.

Breech of Terms/Rules Policies

Any affiliate who is found to be in violation of any of the rules set forth within this page are subject to any of the listed means of disciplinary actions, subject to the APO's discretion.

The APO agrees to notify an affiliate within 72 hours of any disciplinary action that has or will take place via the affiliate's email address that is on file. Depending on the severity of the offense, and at the sole discretion of the APO, the APO may take action against the offending affiliate account before notification is sent to the affiliate. The APO cannot guarantee that the affiliate will receive the notification, however, due to affiliate's invalid contact information, DNS issues on the sending or receiving servers end, or a whole array of other issues which are out of the APO's control that can take delay or prohibit email from being delivered properly.

Liability for breech of TOS resulting in loss of service

Affiliates agree that if their actions, which are in violation of the TOS set forth on this page at the APO's discretion, directly result in the loss of access to this Affiliate Program and/or the website that this Affiliate Program promotes due to suspension by the Affiliate Program's web hosting company, that the offending affiliate will be liable for the downtime at the rate of $150 per day. If it is required by the web hosting company that this website be removed from their servers, the affiliate is liable for a $500 relocation fee. A day is defined as any period of time over 1 minute between 12:00am and 11:59pm.

Jurisdiction and Venue

If any dispute arising from the use of this Website is brought before a court of law at any time, the Affiliate agrees that the sole jurisdiction of such disputes shall be in Ingham County, Michigan, United States. In the event that such disputes require federal litigation, such hearings and disputes will have the sole jurisdiction in Ingham County, Michigan, United States.

Employment Status

Affiliates are not employees. Affiliates cannot make claim to employee benefits including, but not limited to, sick days, holiday pay, overtime, or health benefits. Affiliates are paid on a per-project basis, based on sales revenue, while working from a remote location with no Company supervision.

Taxes

Affiliates will not have taxes deducted from their pay. Affiliates are required, where applicable, to report and pay taxes on earnings paid to them from the Company for services rendered. Affiliates based in the USA will be required to submit a W-9 form to the company when their earnings reach $500. USA-based Affiliates will not be able to perform services for the company when they reach $500 in earnings until they submit a valid W-9 form. USA-based Affiliates may fill out a W-9 form and send it to the Company at any time before December 31 of the current year to receive a 1099 the following year for tax purposes.

Indemnification

By using this Website, the Affiliate agrees to indemnify and hold harmless the Company and Affiliated Parties from all liabilities, losses, damages, judgments, awards, claims and costs, including reasonable attorney's fees that result from use of this Website, whether it is due to authorized use of this Website or unauthorized use of this Website. This includes, but is not limited to, injuries, damages or losses to you or any person, business or entity caused by this Website.

Limitation of Liability

By using this Website, You agree that the neither Company nor Affiliated Parties will be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary or other damages. This includes loss of income or revenue, pain and suffering, emotional distress or similar damages or claims even if the Company has been advised that such damages are possible. If such a liability disclaimer is unenforceable, in no way will the liability of the Company or Affiliated Parties exceed $100.

While the Company endeavors its Website to remain online and accessible at all hours of the day, the Company disclaims any warranty or guarantee of service. The Company in no way guarantees neither that the Website will be accessible for any User at any time nor that the User will be able to use or access any of the Pages on our Website.

Hyperlinks

This Website contains hyperlinks, or "links" to 3rd party websites. Affiliate agrees that accessing 3rd party websites via links is at the sole risk of the User. The Company does not necessarily endorse any 3rd party websites linked to from this Website and cannot guarantee that such 3rd party websites will be accessible, error free, safe or otherwise. User agrees to hold Company harmless for any losses, damages, claims or likewise resulting from visiting 3rd party websites via links placed on this Website.

Disclaimer

While this Company takes great care to maintain a safe environment for Affiliates, the Company does not and cannot guarantee that Website will be free of viruses, worms, Trojan horses or other malicious code. As a User of this Website, you alone are responsible for verifying the integrity and safety of all content obtained from or through this Website.
